Knowledge of options is crucial when facing drug charges

Circumstances can sometimes lead to situations that are less than desirable and may result in criminal charges. In addition, there are times that the police may not follow all the required procedures designed to protect the rights of the accused individual. In circumstances of drug possession and drug trafficking, accused offenders can face harsh penalties and consequences, which is why they should be familiar with criminal justice resources.

Criminal charges for possession of drugs with an intent to distribute include felony charges for possessing any amount of a controlled substance such as cocaine, heroin, methamphetamine or ecstasy, possessing an unlawfully obtained prescription for a narcotic such as Oxycotin, Percocet or Vicodin or possessing an ounce of marijuana or greater. A combination of smaller amounts of several drugs or certain amounts of a drug may be charged as possession with the intent to distribute which is a serious charge.

Drug trafficking charges carry mandatory minimum sentences in prison and enhanced sentencing guidelines can also apply in some circumstances. Additional penalties, including asset forfeiture and fines totaling up to $100,000, may also apply. Drug charges present a serious threat to the future and freedom of the accused individual and cannot be taken lightly. Individuals accused of drug crimes should be prepared to respond to the charges they are facing with a strong criminal defense strategy.

It is imperative that accused individuals understand that they can challenge the evidence being used against them if authorities failed to follow required procedures in its collection and violated their search and seizure protections or their arrest rights. Additionally, it may be possible to challenge the credibility of evidence used against the accused individual such as witness statements.

It is possible that a strong criminal defense strategy may be able to reduce or eliminate the charges the accused individual is facing, which is why it is important for defendants to be familiar with the different criminal defense options that may apply to their situation. For the freedom and future of the accused individual, it is important to be able to reduce the penalties and potentially long-term consequences they are facing.
