Buford woman indicted on murder charges after shooting husband

A 39-year-old Buford woman had been indicted on charges stemming from the shooting of her husband. Additional charges have also been added.

On August 25th, 2018, Gwinnett police officers responded to calls of a man down in the middle of Apple Grove Road in Buford around 1 a.m. Upon arrival, the man was found dead from a single gunshot wound. Just a few hours later, his wife was arrested and charged with his murder.

On Wednesday, November 21st, a grand jury returned indictments on one count each of aggravated assault, felony murder, malice murder, and possession of a firearm. Initial charges only included felony murder and aggravated assault. However, after a complete investigation, it was determined that the woman killed her husband intentionally, and the additional charges were added.

In the state of Georgia, both malice murder and felony murder carry a sentence of life without parole or life with parole after 30 years. In addition, an individual who commits malice murder may also be sentenced to death. GA Code ยง 16-5-1 defines malice murder as "deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart."

Knowledgeable and experienced legal counsel are imperative to defending any criminal charge, but especially where life and death of the defendant are at stake. A defendant should never go into a trial of this magnitude alone.
