Georgia's Grady Memorial incorrectly charges rape victims

Violence between Georgia partners can be both personally and professionally devastating. If there is an allegation of rape, the investigation will include a medical examination to retrieve evidence. This is often conducted at public hospitals, like Grady Memorial. However, a local newspaper investigation has discovered disturbing evidence concerning these examinations.

A local newspaper alleges that Georgia's largest public hospital has improperly charged rape victims. The records of over 700 rape victims have been reviewed, which revealed that rape victims were charged for forensic exams. Grady Memorial is a public hospital and should provide these exams free of charge. The information gathered from these exams is crucial to the pursuit of a domestic violence conviction. To charge these victims for the exam is the equivalent of charging a shooting victim for dusting the weapon for prints.

Whether you are the accused or the accuser, it is important to have evidence properly collected. In the case of the accused, evidence may be used to exonerate an individual by bolstering a self-defense claim. For the accuser, it can strengthen his or her claim by showing the serious nature of the abuse. In some cases, felony charges of aggravated assault may be presented before the court.

Whether an individual is in need of protection from a violent partner or needs defense from these serious charges, a criminal defense attorney may be able to help. An experienced defense attorney will ensure that evidence is preserved and presented appropriately to ensure that the client's position is appropriately represented in court.
