Charges filed in February murder of Smyrna man

On February 25, 2015, a man from Smyrna, Georgia, lost his life. After an investigation, police believe that the murder occurred during the course of a robbery attempt. Four individuals were recently charged with this man's murder.

The four individuals were charged with a variety crimes, including felony murder, aggravated assault, armed robbery and violation of the Criminal Street Gang Act. One of the defendants was also charged with possession of a firearm by a convicted felon. It was reported that two of the defendants are allegedly a part of a local gang known as the Ghost Face Gangsters.

Felony murder in Georgia is defined as a death that occurs during the course of an inherently dangerous felony. In this case the robbery of the Smyrna man was the dangerous felony. It does not matter that the defendants may not have intended to kill. The fact that someone was killed during the course of the felony is enough to convict on this charge. Georgia does not classify murder in degrees. In this state, any killing that occurs without provocation is deemed to be a murder. Those who are convicted of murder will be sentenced based on the severity of the surrounding facts of the situation.

The defendants in this case will have their day in court. Until then, they are being held without bond at the Cobb County Adult Detention Center. They are facing serious charges that can negatively affect their future. In this and all criminal cases, it is important to have a sound defense strategy to ensure that the prosecution will prove every element of the crime.
